Review of ratings

First Tier Review

Once you’ve received your final report, if you disagree with the final ratings given, an approved provider can apply to a regulatory authority for a review of ratings, called a first tier review (Section 141 of the Education and Care Services National Law).

To apply for a first tier review, you must use form SA11 Application for Review of Ratings by Regulatory Authority (Service Rating).

Requests for a first tier review must be lodged with the regulatory authority.

A request for a first tier review must be made within 14 days of the approved provider receiving the final assessment and rating report, and:

  • be in writing
  • set out the grounds on which the review is sought
  • be accompanied by the prescribed information
  • include payment of the prescribed fee.

Second Tier Review

Following a first tier review, an approved provider can apply to ACECQA for a second tier review. This is conducted by a Ratings Review Panel and can only be sought after a first tier review has been completed.

The procedures for second tier reviews are set out in Sections 144 -151 of the Education and Care Services National Law and Regulations 68 to 69 of the Education and Care Services National Regulations.

If an approved provider is seeking a second tier review, they must apply within 14 days of receiving the decision of the Regulatory Authority on a first tier review.

An application must:

  • be in writing include the name of the education and care service
  • include the service approval number
  • include the name and contact details of the contact person for the application
  • include a statement setting out the grounds on which:
  1. the approved provider seeks review of the decision of the Regulatory Authority
  2. specify the quality areas to which the ground for further review relates
  • include payment of the prescribed fee (Section 145 and Regulation 69).

Reassessment and re-rating

An approved provider may also apply to the regulatory authority for a reassessment and re-rating. A fee applies, and an application for reassessment can only be made once every two years.
