Do you need to make a notification about a service?
Certain changes to a service need to be notified to your Regulatory Authority. Refer to the list below for more information.
You need to notify the Regulatory Authority if your service’s hours and/or days of operation change will change.
A change to the service premises includes things such as a change to:
- the design and layout of the premises,
- the approved building,
- the indoor space,
- the outdoor space.
Go to section 5 of the National Law for a definition of education and care service premises.
A waiver application may be needed if the change affects your ability to comply with your obligations under the National Law and National Regulations.
You need to notify the Regulatory Authority if there is a change to the location of the principal office of a family day care service.
You only need to make a notification about a change to the nature of care if you are a centre-based service. For example, a long day care service starts to offer outside school hours care.
If your service approval includes conditions related to the nature of care, then you may need to submit an application to amend service approval.
You only need to make a notification about a change to the ages of children if you are a centre-based service.
For example:
- a service that only provides education and care for children aged 3–5 years, begins providing education and care for children aged birth–2 years.
- a service previously offering outside school hours care now wants to provide education and care to infants.
If your service approval includes conditions related to the ages of children, then you may need to submit an application to amend service approval.
You need to notify the Regulatory Authority if transport is being arranged by the service for the first time or the last time.
You only need to make a notification if you are a centre-based service.
You do not need to notify the Regulatory Authority each time the circumstances of regular transportation change.
A single notification will encompass the whole time your service provides or arranges regular transportation. For example, a single notification could have been made in March 2023 when a service started arranging regular transportation three days per week. Another notification would not be required until the service provided or arranged regular transportation for the final time.
You do not need to notify if the transportation is organised as part of an excursion.
You need to notify the Regulatory Authority if the Approved Provider has not commenced operating a service within six months (or within the time agreed with the Regulatory Authority) of being granted its service approval.
You need to notify the Regulatory Authority if the Approved Provider stops operating the education and care service.
If the Approved Provider stops operating a service, complete an SA12 Notification of change to information about an approved service.
If the Approved Provider stops operating the service for a short time due to an incident, you should submit an I01 Notification of Incident.
You need to notify the Regulatory Authority if there has been a change to a nominated supervisor's name or contact details.
You need to notify the Regulatory Authority if:
- a nominated supervisor’s working with children check, working with children card, working with vulnerable people or teacher registration has been cancelled or suspended
- a nominated supervisor is the subject of other disciplinary proceedings.
If there has been a change in nominated supervisor, please submit a NS02 Notification of Change to Nominated Supervisor.
